Mr Cameron admitted the breach and thus the breach is found proved.

Penalty:

Mr Cameron is suspended from end of racing on 17 April up to and including 21 April. This is two days: Forbury Park on 20 April and Addington on 21 April.

Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Mr K Cameron (OPAWA MACH) forced SARAH KATE (Mr R May) wider on the track near the 1250 metres of race 2 THE KIDZ KARTZ MOBILE PACE.

Rule 869(4) and (6)(b) and (c) reads:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse and its progress.
(6)(b) a horse making a forward movement during any race shall not be forced to race wider on the track.
(6)(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

Mr Tidmarsh stated that Mr Cameron was one out and four back. Mr Orange, who was racing ahead of him, shifted three wide and Mr Cameron followed him out. Unfortunately at this time Mr May was established to Mr Cameron’s outside, and the movement forced Mr May wider on the track.

Mr Cameron said he thought he was clear at the time, but on viewing the videos he could see that he was not.

Submissions for Penalty:

Mr Tidmarsh stated that the respondent had a very good record and had admitted the breach. He had had 71 drives this season and 104 the season before. Mr Tidmarsh sought a suspension of between two and three days.

Mr Cameron stated he preferred a suspension to a fine. He stated his record was good and emphasised he had admitted the charge.

Reasons for Penalty:

The starting point in the JCA Penalty Guide is five drives. On determining penalty Mr Cameron was given credit for his clear record and his admission of the breach. We estimate Mr Cameron has two drives per meeting.
