Informant:       Mr P Knowles, stipendiary steward
Defendant      Mr W Low, licensed horseman and Ms D Brown, trainer

Mr Knowles, stipendiary steward, alleged that in the home straight OUR MONTY (W Low) broke on several occasions in the home straight and failed to lose ground in the break. Mr Knowles sought relegation to behind the 2nd horse.

Judges placings were 1; 9; 10; 5; 3. The margin between 1st and 2nd was a long neck.

Mr Allison, stipendiary steward, demonstrated that OUR MONTY galloped on 4 occasions in home straight. The first occasion was just for a stride, but he assessed that OUR MONTY had galloped in total a distance of some 50 metres.

Mr Knowles emphasised that it was the galloping on the last occasion that concerned the stipendiary stewards. He said Mr Low had not stopped driving out OUR MONTY and the horse had in fact made ground in the break. Mr Chmiel the driver of the 2nd horse BRAMLEY TOWN, said he had looked across to OUR MONTY and was certain that that horse was making ground on his horse when galloping.

Mr Low said OUR MONTY was a rough going horse. He said he did not believe he had made ground in the break. He disputed that he had continued to drive out OUR MONTY when in a gallop. Ms Brown agreed with Mr Low and said in her view the horse was still behind BRAMLEY TOWN after it had galloped and OUR MONTY had regained its stride before pulling away from BRAMLEY TOWN.

We accept the informant’s assessment of the distance over which OUR MONTY galloped.  We are satisfied after hearing the evidence and viewing the video that OUR MONTY did not only not lose ground when in a gallop but did in fact make ground. Mr Low continued to drive his horse out and in fact used the whip on one occasion while OUR MONTY was still galloping. In these circumstances we exercise our discretion and relegate OUR MONTY to behind BRAMLEY TOWN.
