Mr Knowles, stipendiary steward sought the disqualification of EL MELINO pursuant to R 869(7B) in that the horse, placed 2nd by the Judge, had moved inside the pylons rounding the final bend. Placings were 5, 7, 3, 10, 1, 4. Also present at the hearing were Ms Barclay and Mr Swain, driver and trainer of EL MELINO, respectively.

R 869(7B) states: "Where any horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman."

Mr Knowles showed the video of the leading horses travelling the final bend. EL MELINO could be seen to run over three markers for a distance of at least 20 metres. It was not clear whether EL MELINO had brushed or run over a further marker with Mr Knowles saying in his view it was a 50/50 call. Mr Swain indicated he believed the horse on the outside had also contributed to the incident.

The Committee indicated it was not satisfied to the standard of the balance of probabilities that EL MELINO had run inside the fourth marker. In these circumstances it could not be established that EL MELINO's sulky wheel had moved inside the track marker line for more than 30 metres. Mr Knowles sought and was granted permission to withdraw the protest. Placings were thus as called by the Judge.
