Facts:

Mr Tidmarsh, Stipendiary Steward, alleged that Mr N Williamson used his whip in an excessive manner over the final stages of race R7 the CRAMOND & CRAIG LTD MOBILE PACE, when driving KIWI FOCUS.

Mr Tidmarsh demonstrated on the video that Mr Williamson used his whip 22 times in the run home. There was no break in the respondent’s action and the strikes were quite forceful.

Mr Williamson readily admitted the breach stating he accepted there was no pauses. He said KIWI FOCUS was running on and he did not want to break the horse’s momentum. He emphasised on occasion he had used the reins as well as the whip.

Submissions for Penalty:

Mr Tidmarsh produced the respondent’s record, which was clear for the past 12 months. He said Mr Williamson had had over 1070 drives in the past 2 seasons. He submitted a fine of $300 was appropriate.

Mr Williamson stated he had no argument with this.

Reasons for Penalty:

Mr Williamson has used his whip 22 times in the run home. KIWI FOCUS was given no respite. The fact that the respondent did not want the horse to lose momentum is no excuse for his actions.

The breach is mid range and we adopt a $500 starting point as recommended in the Penalty Guide. Credit has to be given for the respondent’s ready admission of the breach and his excellent record with respect to this rule. A discount of $100 is given for each of these mitigating factors.
