Mr Knowles, stipendiary steward, alleged that in race 7 ASK MCARDLE, placed 3RD by the Judge, broke from its gait some 30 metres from the finish and was lapped on by NUMERO UNO when it galloped across the line. Placings were 7; 1; 5; 2; 6; 3. The margin between 3rd and 4th was a head, with a further 1 L ¼ back to the 5th horse.

Mr Knowles read R 870(5) and had Mr Allison, stipendiary steward, demonstrate by reference to two video angles that ASK MCARDLE was lapped on by the afore-mentioned runner when it galloped across the line. There was no suggestion that ASK MCARDLE had galloped as a result of receiving interference.

Mr Armour, the driver of ASK MCARDLE, indicated that he concurred with the stipendiary steward’s analysis of the videos.

We find that ASK MCARDLE galloped for some 30 metres and was still galloping when it crossed the finishing line. In these circumstances we uphold the protest and ASK MCARDLE is relegated to 4th.
