Facts:
Following the running of Race 7, Ratanui Development Company Handicap, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that L Hemi allowed her mount NYMPH MONTE to shift inwards near the 800m crowding PERRY MASON (R Jones) and IRISH WHISPER (K Myers) in onto SHE KNOWS (V Colgan) which was checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Hemi is an apprentice rider and was assisted by Mr S Barlow.
Using the back straight video Mr Goodwin identified the runners involved. The horse closest to the rail who received the check was SHE KNOWS ridden by V Colgan. Outside of him, in order, were IRISH WHISPER, PERRY MASON and NYMPH MONTE (L Hemi). Mr Goodwin paused the film at a point near the 800m bend and showed all mentioned horses racing unimpeded and with clear racing room. On the bend however, positions tightened which resulted in Mr Colgan running out of room and being forced to take hold of his mount. SHE KNOWS lost approximately two lengths of ground in the incident. Mr Goodwin said the crowding was caused by Ms Hemi’s inward movement when not sufficiently clear.
Ms Hemi told the committee that Reece Jones, who was racing to her inside, yelled out that there were “two inside of him” meaning there were two other horses between him and the rail. Ms Hemi misunderstood and thought Mr Jones meant there were two horses to her inside. As a result Ms Hemi thought she was one of a line of three horses where in fact there were four.
Submissions for Penalty:
Mr Neal classified the degree of carelessness as in the midrange. He said Ms Hemi misjudged the situation and let her mount move in on the corner when not sufficiently clear of the other runners. Her riding record under the careless riding rule is clear for the last 12 months. The Stewards' submission was for a period of suspension. Mr Neal said while Ms Hemi rides predominantly in the Central Districts she has ridden in Canterbury and is intending to ride down there over the next few weeks. This was confirmed by Ms Hemi telling us she had purchased plane tickets to Christchurch.
Reasons for Penalty:
In coming to a decision on penalty the committee had regard to the Judicial Committee’s penalty guide and adopted as a starting point a five day suspension.
In our opinion the degree of carelessness was towards the lower end of mid-range. Ms Hemi was aware of leaving room to the runners on her inside but misunderstood Mr Jones when he called to her. We did not believe the degree of carelessness warranted any uplift in penalty. There were a number of submissions put forward as mitigation. Ms Hemi readily admitted the breach and she has an unblemished record under the careless riding rule.
Taking into account all the submissions and allowing a reduction for the mitigating factors we imposed a three day suspension. The committee also had regard to the fact that two of the days included in Ms Hemi’s period of suspension carry premier status. Ms Hemi advised that she had bought plane tickets to Christchurch in anticipation of riding there but she did not have any firm commitments to date and would prefer any suspension to begin after Tuesday November 3rd.
