Decision:

Following the running of Race 3, Mr. N Goodwin, Stipendiary Steward, lodged an information alleging that rider B.Lammas the rider of SUMMER RAIN used his whip excessively prior to 200m.

Following the running of Race 3, Mr. N Goodwin, Stipendiary Steward, lodged an information alleging that rider B.Lammas the rider of SUMMER RAIN used his whip excessively prior to 200m.

Mr. Lammas admitted the breach.

Mr. Goodwin played video footage outlining the incident where Mr. Lammas hit his mount at least 10 – 11 times prior to the 200m which is well outside the established whip guidelines. Mr. Lammas won the race and the Stipendiary Stewards said that he could be seen to have gained an unfair advantage over other riders who were riding within the guidelines.

Mr. Lammas has two previous charges under this rule:

29/10/09 Otaki  $300

The Stipendiary Stewards submitted that due to Mr. Lammas’s record a substantial fine be imposed in the vicinity of $800 - $1200.

Mr. Lammas was very forthcoming and said that he knew as soon as he got in from the race that he had been outside of the whip guidelines. He accepted that a larger monetary penalty was appropriate.

In coming to a decision on penalty the committee took into account all of the submissions including Mr. Lammas’s full and frank admission of the breach.

We concurred with the Stewards that Mr. Lammas could be seen to have gained an unfair advantage over other riders who were complying with the rules. He won the race aboard SUMMER RAIN by a half head.

--

We were particularly concerned about Mr. Lammas’s record with this being his third charge in less than 5 weeks. The monetary penalty imposed today reflects this concern.

Mr. Lammas is fined the sum of $1000.
