Following the running of Race 5 Mr J.Parkes was charged with careless riding under rule 871 (1) (d). The information alleged J.Parkes allowed Silver Treasure to shift in when not clear of Minkum which was denied its rightful line of running which it was entitled to.

Mr Parkes did not admit the breach and was represented by Mr Belsham.

Mr Ray (Stipendiary Steward) showed the incident on the available films. He demonstrated Mr Parkes (Silver Treasure) moving inwards when not clear of Mr Harris riding Minkum. Mr Harris was forced to stop riding after losing his rightful line of running and as a result became awkwardly placed.

Mr Parkes did not stop riding and only straightened his mount when close to the finish line despite having prior opportunity to do so.

Mr Parkes told the committee he had no idea that Mr Harris had come from behind and was moving up on his inside. It came as a surprise to him that there was an enquiry as he thought that he had won the race fair and square. He also said that, despite drifting inwards, at no stage did he make any physical contact with Mr Harris’s mount.

Mr Belsham said that Mr Parkes had been aware of the other two horses closer to the rail but was confident he was clear of them as he moved inwards. He also said he could understand how Mr Parkes missed Mr Harris on his inside as the horse came up quickly from behind him.

In summing up Mr Goodwin pointed out that Mr Parkes had moved from a position approximately ten horse-widths wide on the track to be in a position approximately four horse-widths off the fence. He was riding with vigour and did not attempt to straighten his mount. Mr Harris was entitled to a clear run to the line and on this occasion he did not receive it.

Decision

--

The committee had careful regard to all of the submissions put before it. It was our view having considered the films at length and taking into account the evidence that Mr Parkes did move inwards when not clear of Mr Harris. That Mr Parkes was unaware of Mr Harris’s position on his inside and that there was no contact between the two horses did not negate the fact that interference had occurred. The committee subsequently found the charge of careless riding proved.

Mr Goodwin produced Mr Parke’s riding record which showed the following careless riding charges:

21/6/07 3 days Wanganui

Mr Goodwin told the committee that Mr Parkes was one of the better apprentice riders who gets a lot of rides and has a very good riding record. He said that on this occasion the interference was not at the top end of the scale however it did warrant a term of suspension.

Mr Belsham told the committee that Mr Parkes had riding commitments at Trentham on Tuesday November 6th.

In coming to a decision on penalty the committee considered all of the submissions put before it. It was our opinion that a suspension be imposed particularly since a relegation had occurred.

We would normally have considered a four to five day suspension but for the favourable comments put forward by the Stipendiary Stewards and Mr Parke’s very good riding record.

--

Mr Parkes is suspended from the conclusion of racing on Tuesday November 6th until the conclusion of racing on Tuesday November 13th – in effect three days.
