Decision:

Ms Latta’s request for approval to late scratch MISS OAHU from Race 5 was declined. 

Facts:

Prior to the running of Race 5 (Power Farming Rating 72 1200m), Information A12277 was filed with the Judicial Committee.

It sought a ruling in relation to Rule 534(2)(b); specifically that Trainer L Latta be permitted to scratch the horse MISS OAHU from Race 5.

Where a Stipendiary Steward is not satisfied that there are circumstances that warrant a horse to be scratched, Rule 534(2)(b) requires him/her to file an Information with the Judicial Committee to determine “whether there are such circumstances and whether the Trainer or Owner or lessee (as the case may be) or his Agent or its Racing Manager is authorised to scratch the horse after that time.” The Rule also provides that a material change in the condition of the track, occurring after the scratching deadline on the relevant Race day, shall be deemed by the Stipendiary Steward and the Judicial Committee to constitute such circumstances.

Submissions for Decision:

Ms Latta elected to not attend the Hearing, but Mr Goodwin advised the Committee that on advice from regular rider Mr Hannam, she had sought permission for the horse to be scratched. Mr Hannam had believed that MISS OAHU would not handle the track as he felt it was patchy and she was therefore unsuited to it.

Mr Goodwin advised that the track was a Dead 6 and after receiving feedback from other riders, stewards took the position that there was no justification in changing the track’s classification. As such, they were opposed to Ms Latta’s request. He confirmed that she had made the request following Race 3, and that Mr Hannam’s views were based on his experience with the mounts he had ridden in earlier races on the day.

Mr Goodwin confirmed that he had spoken to Mr Hannam and identified that the jockey believed MISS OAHU should be scratched as it would also interfere with punters who would place money on the horse which in his opinion would not handle the track.

Reasons for Decision:

The Committee had regard to the submissions made, and notes that the basis of the request from Ms Latta to scratch her horse was due to a perceived change in track conditions, and how the horse might therefore handle the track. We accept that the track continued to be classified as a Dead 6, and as such, we were satisfied that there had not been a material change in the condition of the track.
