Decision:

As Mr Parkes admitted the breach of careless riding under the provisions of Rule 638(1)(d) the charge was found to be proved.

Penalty:

The Jockey’s Licence of Mr Parkes was suspended from the end of racing on 25 April 2016, up to and including racing on 12 May 2016 (10 days).

The committee was mindful that a Premier day was scheduled for 7 May 2016 at Canterbury and that Mr Parkes has ridden at Premier meetings in the South Island in the past.

Facts:

Following the running of Race 8 (The Pavemasters Handicap) Information No. A7659 was filed with the Judicial Committee. It was alleged that Mr Parkes, the rider of COPPER REIGN angled his mount out near the 500m dictating GRAYZE ANATOMY (D Turner) outwards into the line of ELUSIVE BOXERS (D Bradley) when not clear.

Rule 638(1)(d) provides:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Parkes acknowledged that he understood the Rule, the charge and confirmed that he did admit the breach.

Mr Goodwin had Mr Whiterod identify all runners on the available films. Mr Goodwin then stated that Mr Parkes was racing adjacent to the running rail, to his outside was GRAYZE ANATOMY and coming around the outside was Mr Bradley’s mount ELUSIVE BOXERS. He said that the most graphic picture that they had of the incident, was near the 500m mark, where you could see Mr Parkes turn his horse’s head sideways and start to go for a run to the outside of the runner ahead of him and in doing so he comes out more than he possibly intended. This shifted GRAYZE ANATOMY into the line of Mr Bradley’s mount. He added that Mr Bradley’s mount clipped a heel and almost fell, with Mr Bradley being dislodged. Mr Goodwin said that the side-on film showed that the horse ahead of Mr Parkes was not stopping or placing Mr Parkes in any sort of danger.

Mr Parkes, for his part, said that his intentions were to slide off the horse ahead to follow Lisa Allpress, but that he pretty well misjudged it as he went to slide off and that he ended up in an awkward spot on heels. He then said that he had to dodge heels and come out a bit more. He added that his horse over-reacted a bit, came out more and caused interference. In response to a question from the chair, Mr Parkes said that his intentions were to come off the fence but not as abruptly and that when he shifted he was clear of the heels of the runner ahead, but that he just went up too quickly.

Submissions for Penalty:

Mr Goodwin said that Mr Parkes had been suspended on three separate occasions for careless riding during the past 12 months, with the most recent being at Marton on 4 March 2016 when he was suspended for 3 days. The record showed that he had also been suspended at Marton on 12 September 2015 – 6 days, and at Waikato on 15 August 2015 – 6 days. When questioned by the Chair as to the total number of suspensions imposed on Mr Parkes in the last 12 months, Mr Goodwin said that it was 4. Mr Parkes agreed that this was correct. Upon further perusal of the records by the Judicial Committee it was established that he had in fact only incurred 3 suspensions during that time. Mr Goodwin added that Mr Parkes’ mount may have come out more than he anticipated, nevertheless if he had not shifted, the incident would not have happened. He said that he placed the degree of carelessness, whilst not at the top end, was above mid-range.

Mr Parkes said that the record was correct and that Mr Goodwin had summed the incident up “much to how it was”. After being given the opportunity by the committee to discuss the matter of commencement of any suspension with his Agent, Mr Parkes asked that any suspension to be imposed, start immediately.
 

Reasons for Penalty:

Several factors were taken into account when considering quantum of penalty.

Viz:

1) The admittance of the breach.

2) Mr Parkes’ record of 3 prior suspensions during the past 12 months, which the committee considered to be reasonable.

3) That the degree of carelessness in the opinion of the committee was at the top end of mid-range, as he clearly angled his mount out abruptly when not clear.

4) The JCA starting point of 5 days suspension for careless riding.

5) The carelessness displayed by Mr Parkes resulted in Jockey Mr Bradley being dislodged from his mount. The Stipendiary Steward stated that Mr Bradley’s mount clipped a heel, however in the opinion of the committee; the clipping of a heel is difficult to prove with certainty.

6) Other penalties imposed for similar breaches, including the most recent when Mr M was suspended for 14 racedays by the Raceday Committee, with that penalty being reduced to 11 riding days by an Appeal Committee.

Following careful consideration of all matters pertaining to penalty, the committee determined that a period of suspension encompassing 10 riding days was an appropriate penalty.
