As Mr Doyle admitted the breach the charge was found to be proved.

Facts:
Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (c) in that Shannon Doyle struck his mount forward of the shoulder with his whip near the 1800 metres.
Rule 638 (3 (c) states:
(3) A Rider shall not:
(c) strike a horse forward of its shoulder;
Race 6 was run over 2100 metres and soon after the start Mr Doyle was in the lead on BEAU AGEN. As the field went over the crossing BEAU AGEN tried to run off the track. In an attempt to keep his mount in a straight line and stop it running off Mr Doyle hit the horse once on the neck. Mr Goodwin said there was no malice in what he did and he did not hit the horse in anger. Mr Doyle admitted to doing this but was unsure what other options he had. He said he did not hit it near its head and it was only the one strike on the neck.
Submissions for Penalty:
Mr Goodwin said there were only two other breaches of this rule that he was aware of. These were rider R fined $450 and rider M fined $100 however he did not know the details of those breaches and how they compared. The stewards’ submission was for a fine of not less than $200.
Mr Doyle asked the committee to take into account that it was only one strike and while it was forward of the shoulder it was not near the head.
Reasons for Penalty:
Rule 638(3) (c) is quite specific in that a rider must not strike their horse forward of the shoulder. The Committee took into account that Mr Doyle hit his horse only once and it was not around the head area which we would consider a more serious breach. We also had regard to the circumstances in which the breach occurred. While not condoning Mr Doyle’s use of the whip his reaction was understandable as he tried to prevent a potentially serious situation developing. We placed the breach at the lower end. Mr Doyle readily admitted the charge and has an excellent record. Previous breaches quoted by the stewards were not particularly helpful without further details.
