Under rule 850 (1) & (4): An information was lodged by Stipendiary Steward Mr N Goodwin against Jockey Mr C Carmine for presenting himself to be weighed out in a vest which had been modified and which was not compliant with the rules.

Mr Carmine admitted the breach.

Mr Goodwin told the committee that Mr George had checked Mr Carmine's vest as he was weighing out prior to the race. Mr George showed the altered vest, pointing out the many panels that had been tampered with. It appeared that the panels on the upper back part of the vest had been sliced open and that many of the pads had been removed.

Mr Carmine explained that the vest was uncomfortable to wear and that he had modified it to try and make it more comfortable. He does not currently have any weight problems.

Mr Goodwin explained that the Stewards take breaches of this rule very seriously as the wearing of an approved vest is critical for rider safety. He called for a suspension in the vicinity of two to four weeks in line with other recent penalties.

DECISION:

--

In coming to a decision the committee had to regard all submissions put before it, including the extent of the tampering to the vest and the fact that it was clearly a deliberate act by Mr Carmine. The committee also noted that this was Mr Carmine's first breach of the rule. While accepting that Mr Carmine altered the vest to aid comfort rather than to shed weight the committee was of the opinion that a suspension was the appropriate penalty.

Taking into account other similar breaches of this rule, Mr Carmine was suspended from the close of racing on Tuesday November 4th 2008 until the close of racing on Saturday November 22nd 2008.
