Following the running of Race 3, Patrick Myers Harcourt Maiden, Jockey P Taylor lodged an information instigating a protest alleging interference by the horse BELLA KASH or its rider, L Cropp,
| -- DECISION AND REASON: --Following the running of Race 3, Patrick Myers Harcourt Maiden, Jockey P Taylor lodged an information instigating a protest alleging interference by the horse BELLA KASH or its rider, L Cropp, placed first by the Judge interfered with the chances of BROOKLANDS BOWL placed second by the Judge in the final straight. ----Margin ? Nose ----Mr P Taylor alleged in the run to the line Ms L Cropp allowed her mount to shift out, made contact with BROOKLANDS BOWL, and from being in front he got beaten a nose. Mr Taylor demonstrated his interpretation of the incident with the use of the side and head on films available. ----Ms Cropp stated she had been in front and Mr Taylor had a long time to get past, whilst BELLA KASH had moved out BROOKLANDS BOWL had moved in. ----Mr Taylor replied he may have moved in but Ms Cropp moved out and bumped him. ----Mr Bolton produced a copy of the photo finish, used the film to show where his horse was put off stride, contact was obvious and his horse should be promoted. ----Stipendiary Steward K Hawea, as entitled under the rules gave evidence, that Mr P Taylor may have been forced off the line he was entitled to, and with the margin of a nose his chances may have been affected. ----In reaching their decision, the committee, having heard all the evidence and viewed the films available, concur the obvious movement outwards of BELLA KASH and the minor contact to BROOKLANDS BOWL. Also allowing in their decision is the slight movement of BROOKLANDS BOWL, the distance of approximately seven or eight strides from the finishing post where the incident occurred and the margin of a nose between the horses at the finish line. ----The committee find the contact to be of a very minor nature, Mr Taylor was never inconvenienced in his ability to continue riding his mount out with the whip to the completion of the race, clearly shown by the side on film. BROOKLANDS BOWL never changed stride or appeared to lose momentum. We will never know if the interference had not occurred in what order the horses would have finished. Using the discretionary powers given to the committee under Rule 876(1)(2)(a), find the interference to BROOKLANDS BOWL by BELLA KASH affecting its chances not proven, accordingly the protest is dismissed and the Judge's placing stand. ----1st - BELLA KASH --2ND - BROOKLANDS BOWL --3rd - TARTAN HERO --4th - 6, 5th - 1, 6th - 9 |
