| -- DECISION AND REASON: --(Mr J Clement, the trainer of DANCING PRINCE, and Mr J Wheeler, the part-owner and trainer of VAL EWE have prior commitments in the next race and are unable to attend immediately.) --Stipendiary Steward, Mr N Goodwin, lodged an information alleging interference occurred over the final stages of Race One, the Fair Tax for Racing Maiden Hurdles. --Judge's Placings: 5 ? 1 ? 3 ? 4 ?2 ? 8. --The protest is 4th v 2nd, margin between 3rd and 4th is a long neck. --Mr Goodwin demonstrated the head-on and side-on films, the alleged interference. --DANCING PRINCE out wide on the track and being ridden out with the whip, running in and across the line of VAL EWE, in the run to the line, after both horses had jumped the last fence. Mr Ropiha, the rider of VAL EWE took a strong hold of his mount to the point of standing in his irons to avoid DANCING PRINCE crossing the line VAL EWE was entitled to, in its run to the finish. --Mr Turner stated that he had straightened his mount. --Mr Ropiha demonstrated on the films available, that he had to stop riding, it had cost him a half-length. Mr Goodwin, in summarising, stated that it was clear the Mr Turner's mount had shifted in, costing VAL EWE a higher placing. --In reaching their decision, the committee have taken into account the movement by DANCING PRINCE, the angled movement inwards over two to three horse widths by Mr Turner with continual use of the whip. Mr Turner did attempt to correct his mount but well after the damage had been done. Mr Ropiha was severely inconvenienced in his ability to ride out the finish of the race, and the committee is satisfied that there was interference. --In exercising their discretion to relegate, the committee was satisfied that the interference was not minor. The manner in which VAL EWE was sustaining its run to the line prior to the incident, the amount of ground VAL EWE lost when its line was dictated by DANCING PRINCE when not sufficiently clear was not less than half a length, when the margin between 3rd and 4th was a long neck and was sufficient to cost it any chance of finishing in a higher place. --Taking all these matters into consideration, the committee is satisfied that VAL EWE would have finished in a higher place and the protest is upheld and the final placings are ? --1st - No.5 --2nd - No.3 --3rd - No.4 --4th - No.1 --5th - No.2 --6th - No.8 |
