Decision:

As Ms Myers admitted the breach the charge is found proved.

Penalty:

Ms Myers is suspended for 4 riding days from the close of racing on Thursday 11 August 2016 to the close of racing on Thursday 19 August 2106 – the 4 days being Te Aroha (12 August), Riccarton (13 August), Avondale (17 August) and Taupo (19 August).

Note: The decision to abandon the 12 August Te Aroha meeting was taken after the completion of this hearing and Ms Myers being advised of the Committee's decision.

Facts:

Following the running of race 3, the “Larry Vickers Cartage N Crane Maiden”, Information A7681 was filed by Stipendiary Steward, Mr N Goodwin under Rule 638(1)(d). The Information stated “R Myers “Tabard” allowed her mount to shift outward near the 300m when not clear of “Denny’s Lincoln” (M Tanaka) which was dictated outward hampering “Billie Bud” (B Hutton) and “Valentia” (D Turner)".

Ms Myers signed the Information stating she admitted the breach and at the beginning of the hearing confirmed that was correct and also that she understood the rule under which she was charged.

Rule 638(1)(d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.

Submissions for Decision:

Mr Goodwin, using the head-on and side-on films of the race from approximately the 350m mark, identified Ms Myers on “Tabard” racing some 4-5 horse widths off the rail and just behind the then leader “Devi” (D Hirini). He said just prior to straightening up for the run home Ms Myers shifted outwards from behind the leader but in doing so dictated “Denny’s Lincoln” outwards causing “Billie Bud” and “Valentia”, which was racing the widest on the track, to be hampered. He said “Tabard” was having its first start and appeared to shift out further than Ms Myers had possibly anticipated and as a result “Denny’s Lincoln” was dictated outwards into the line of “Billie Bud” which became awkwardly placed on the heels of that runner and then shifted out further hampering “Valentia”. Mr Goodwin said he believed “Tabard” overreacted when shifting outwards and Ms Myers did take corrective acting to straighten her horse but by that time “the damage had been done”.

To a question from the Committee Mr Goodwin said he placed the degree of severity below the mid range saying that whilst 3 riders had been affected none had been forced to sharply check their mounts.

Ms Myers said she believed “Denny’s Lincoln” was starting to weaken as the horses rounded the final turn and she had tried to establish herself to his inside and as she moved outwards her horse overreacted. She pointed out that she did take immediate corrective action but agreed with Mr Goodwin that by then her actions had caused the interference to the other horses. She said her horse and all the affected runners were having their first start and in her view “Billie Bud” in particular had overreacted making the incident look worse than it was.

Submissions for Penalty:

Mr Goodwin said Ms Myers had not breached the careless riding Rule in the previous 12 months. He said this was a very good record for a very busy rider who rode throughout the country. He did not submit what he believed was an appropriate penalty other than to say that he did not believe it should be more than the 5 day starting point used by the JCA for breaches of this Rule.

Ms Myers made no submissions on penalty other than to ask the Committee to take into account her very good riding record. After consideration she said she wished to defer any suspension that might be given for the maximum permissible 7 days.

Reasons for Penalty:

The Committee has reviewed films of the incident and taken into account all the submissions made. The films clearly show that as she rounded the bend into the home straight Ms Myers was pushing her horse along and when going for a run moved outwards from behind Ms Hirini when not the required distance in front of Mr Tanaka. Ms Myers did not look to her outside before making her move and as a result Mr Tanaka was dictated outwards which caused the resulting interference to Mr Hutton and Mr Turner. The Committee accepts that Ms Myers’ mount may have slightly overreacted when shifting outwards but had she looked to her outside prior to making her move she would have seen how close Mr Tanaka was to her and possibly delayed her move by a fraction. That she took immediate corrective action is accepted but, as she has accepted, by then it was too late and her actions had a “concertina affect” on Mr Hutton and Mr Turner.
The Committee places the degree of severity close to mid range.

The JCA’s Penalty Guidelines state the starting point for a breach of the careless riding rule is 5 riding days. Having taken into account the aggravating factors above we have also taken into account Ms Myers’ admittance of the breach and also her very good record in relation to this Rule. We have also taken into account that in recent months Ms Myers has ridden, on occasions, in the Northern region and regularly rides at the Riccarton Winter Cup Meeting.

The Committee believes the interference caused must be reflected in an appropriate penalty which we have decided is a period of suspension. From a starting point of 5 days we have reduced that by 1 day in recognition of Ms Myers very good riding record and her admittance of the breach of the rule.

Ms Myers’ request for a deferment of her suspension is approved in terms of Rule 1106(2).
