--Mr Finnegan, by way of explanation told the committee he had contemplated racing the horse ARADHANA again on Sunday after racing the previous day. After discussion with the owner he decided not to proceed and forgot to notify the authorities at the appointed time. He was aware of the time frame for scratchings.
--Mr Goodwin, stipendiary steward, informed the committee this was the third time that Mr Finnegan had been charged under this rule. The other times were 5 June 2006 and 2 November 2006. He asked for a fine of $300 to reflect the seriousness of the charge and the regularity of it occurring. Fortunately no other horse was denied a run.
--The committee informed Mr Finnegan that the regularity of this offence happening was simply not good enough. He was told that the fine reflected the fact that this was the third time he had been charged, and the fine would have been substantially more if another horse had been denied a start.
--Mr Finnegan was fined $300.
