Ms O’Beirne’s Apprentice Jockey’s Licence was suspended from the close of racing on 4 August up to and including racing on 15 August 2018.

Facts:

Following the running of Race 4 (DENNIS YAXLEY 1600), Information No A9234 was filed with the Judicial Committee. It was alleged by the Informant that Ms O’Beirne angled her mount BROTHER ONE outwards when not clear of NITRO TED which was checked near the 600m.

Ms O’Beirne said that she understood the Rule, the charge and confirmed to the Committee that she admitted the breach.

Rule 638(1)(d) provides:
A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless

Mr Goodwin showed the relevant film replays, identified the horses and riders and said that approaching the 600m Ms O’Beirne shifted her mount out to get on MAUNA KEA’s back and in doing so tightened and checked NITRO TED. Mr Goodwin did agree that Ms O’Beirne’s mount was turned outwards after touching the shoulder of NITRO TED and that that made the incident appear a little worse than it was.

Mr Sharrock for Ms O’Beirne said that contact had been made and that Ms O’Beirne did attempt to come off NITRO TED. He said that it appeared that Ms O’Beirne attempted to get onto the eventual winner’s back and in doing so made it a little tight on NITRO TED.

Submissions for Penalty:

Mr Balcombe said that Ms O’Beirne had a good record in having only one prior breach of the Rule, that being on 2 April 2018 when a 5 riding-day suspension was imposed. He said that the Stewards placed the carelessness below mid-range and submitted that a suspension be imposed.

Mr Sharrock said that Ms O’Beirne had a good record and had admitted the breach.

Ms O’Beirne confirmed that she had a good record and asked the Committee to take into consideration that she did attempt to relieve the pressure when she realised she had made it tight on NITRO TED. Ms O’Beirne asked that any suspension imposed start after racing on 4 August.

Reasons for Penalty:

The Committee was satisfied that Ms O’Beirne had ridden carelessly. Approaching the 600m she gradually allowed her mount to come out away from the running rail and in doing so tightened NITRO TED who was checked from its rightful running position. The Committee observed that Ms O’Beirne’s mount was turned outwards when contact was made, however this would not have occurred if Ms O’Beirne had not shifted her mount out. The Committee placed the carelessness in the low-range category due to the shift being minimal.

Taking into account the JCA Penalty Guide and the admission of the breach, the Committee determined that a 5 riding-day suspension was the appropriate penalty.
