Decision:

The Information alleges that L McFarlane rode carelessly when he allowed his mount to move inwards near the winning post on the first occasion.  The result being that TU PAY PEAT (I Lupton) was forced inwards onto CITY MISSION (P Cunningham) who was checked.



The Information alleges that L McFarlane rode carelessly when he allowed his mount to move inwards near the winning post on the first occasion.  The result being that TU PAY PEAT (I Lupton) was forced inwards onto CITY MISSION (P Cunningham) who was checked.

Mr McFarlane was present at the hearing and did admit the breach.

Headon and Sideon Films were shown of the alleged incident and clearly showed the inward movement and a severe check to CITY MISSION.

Mr McFarlane had no questions nor did he wish to make any statement.

--

When asked by the Chairman if he only rode in highweights and jumping races he did confirm that to be correct.

--

Mr Goodwin for his part said the breach was not of a minor nature and warranted a term of suspension.

--

Mr McFarlane when given the opportunity did not wish to make submissions as to penalty.

--

The Chairman felt it only fair to point out to Mr Farlane he was entitled to a deferment of any penalty and that there were four jumping races at Hastings on the 22nd May.

Mr McFarlane said he would appreciate a deferment until after Hastings.

--

When arriving at a penalty the Committee took into account Mr McFarlane’s good record and his admission of the breach.

--

 

--

However the foregoing factors are outweighed by the fact Mr McFarlane did move inwards causing a severe check to the horse CITY MISSION.

--

 

--

He may ride until the conclusion of Racing on the 22 May 08 and is then suspended until the conclusion of racing on the 4th June 08 in effect 3 days at which he would have the opportunity to ride.
