At the Egmont Racing Club meeting on the 14 October 2006, an Information was filed pursuant to Rule 828 (1) (2), where it was alleged by the informant Stipendiary Steward, Mr Goodwin, that the trainer of MADAME SHINKO, Mr J Wallace, committed a breach of that rule when he failed to scratch the horse by the required time.

Decision & Reason:

At the Egmont Racing Club meeting on the 14 October 2006, an Information was filed pursuant to Rule 828 (1) (2), where it was alleged by the informant Stipendiary Steward, Mr Goodwin, that the trainer of MADAME SHINKO, Mr J Wallace, committed a breach of that rule when he failed to scratch the horse by the required time. Due to the unavailability of Mr Wallace, the hearing was adjourned and heard on 19th October 2006 at the Hawkes Bay Racing Centre.

Mr Wallace admitted to breaching the rule, and stated it was an oversight on his part.

Mr Goodwin stated he received a call from Mr Wallace at approx 10.30am to say he had forgotten to scratch MADAME SHINKO, which had been undergoing veterinary services.

Mr Goodwin advised that it was a Listed Race and there were 5 horses balloted out, which any one of them may have replaced MADAME SHINKO.

--

Mr Goodwin's submission on penalty, suggested a fine of not less than $300.

--

Mr Wallace had no submissions on penalty.

The Committee after taking all submissions into account, in particular the view that Mr Wallace's actions denied one of the balloted horses the opportunity to compete in a Listed Race.       Accordingly, the Committee imposed a fine of $400.
