Mr Singh is suspended from the close of racing on Thursday 18 October 2018 to the close of racing on Wednesday 24 October 2018.
Facts:
Following the running of race 2, the “BNT Group1600”, Information A12251 was filed by Stipendiary Steward, Mr Goodwin under Rule 6381)(d). The Information stated “in that M Singh angled his mount “Adonis” outwards when not clear of “Surrey” which was checked near the 350m”.
Mr Singh signed the Information stating he admitted the breach and at the beginning of the hearing confirmed that was correct and that he understood the Rule under which he was charged. He was assisted by senior rider Mr Hannam.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
Using the available films from the point of the bend at the top of the straight – approximately 350m from the finish - Mr Goodwin identified Mr Singh racing 1 off the rail immediately behind the leaders. He said Mr Singh allowed his mount to get up onto the heels of the horse directly in front of him – “Prized Pins” – and when he realised he was too close he abruptly angled his mount outwards into the path of “Surrey” ridden by Mr Elliot which was checked. Mr Goodwin said he believed Mr Elliot had to stop riding his mount for 4 strides before he became balanced up again.
Mr Singh said that rounding the turn he felt “Adonis” was “flat out” and he was surprised at how quickly he got up behind “Prized Pins” when he asked the horse for an effort. He said he felt he clipped heels a couple of times and shifted outwards to avoid any more trouble.
Mr Hannam said he thought “Adonis” got on the heels of “Prized Pins” because “Prized Pins” was starting to stop at the same time as “Adonis” was responding to the urgings of Mr Singh. He said a more experienced rider would have eased back off heels but because of Mr Singh’s inexperience he angled outwards without checking to see who was behind him.
Submissions for Penalty:
Mr Goodwin said Mr Singh had been charged twice with a breach of the Rule in the previous 12 months – on 25 November 2017 when he was suspended for 9 national riding days and on 23 October 2017 when he was suspended for 3 Central Districts days. He said Mr Singh was not the required distance clear of Mr Elliot when he shifted outwards and should have taken a hold rather than move outwards. He said the Stewards considered the severity of the breach to be in the low range and that a penalty of a period of suspension should be imposed although did not indicate a specific number of race days.
Mr Singh had no comments to make other that to seek a deferment of any suspension until after the Woodville meeting on Thursday 18 October 2018.
Mr Hannam reiterated that the incident happened because of Mr Singh’s inexperience and that it would be good learning experience for him.
Reasons for Penalty:
The Committee has reviewed the side-on and head-on films of the incident and Mr Singh and Mr Hannam have not disputed Mr Goodwin’s interpretation of those films. It is clear in viewing them that when Mr Singh angled “Adonis” outwards after clipping the heels of “Prized Pins” in front of him he did so quite suddenly and was not the required distance clear of Mr Elliot who was then forced to restrain his horse for approximately 4 strides having been denied his rightful line of running at that time. Whilst the outward movement of Mr Singh was quite sudden we assess the severity of the breach as low as the check to Mr Elliot was not severe although it did momentarily cause him to have to rebalance his mount before being able to complete his run to the finish line.
Mr Hannam commented that Mr Singh is an inexperienced Apprentice and this was the reason for the breach of the Rule occurring. The Committee notes Mr Singh has had approximately 520 race day rides in the 4 years he has been riding with the majority of those rides being in the last 18 months and with that amount of experience we believe he should have perhaps reacted differently.
The Committee has taken into account Mr Singh’s admittance of the breach and consider his record over the previous 12 months in relation to this Rule to be a neutral factor given his two previous breaches of the careless riding Rule occurred prior to the end of November 2017.
The Committee believes on this occasion a period of suspension is an appropriate penalty. The starting point for a low-level breach is a suspension of six national riding days. Taking all of the above into consideration we have decided from that start point the penalty should be reduced by one national riding day and Mr Singh is suspended for five national riding days. His request for a deferment of the suspension is approved in terms of Rule 1106(2).
