Information 6444 alleges that Miss K Hercock the rider of BEYOND allowed her mount to shift inward when not clear of AIMEES IDOL (D Walsh) causing that runner to check.
Information 6444 alleges that Miss K Hercock the rider of BEYOND allowed her mount to shift inward when not clear of AIMEES IDOL (D Walsh) causing that runner to check.
--Information 6443 alleges that Miss K Hercock, the rider or BEYOND, allowed her mount to shift inward when not clear of AFRICA (J Parkes) who was dictated in onto TUSCANY DANCER (P Taylor) who was checked and forced in onto ROSETTI BAY (L Cropp) which was tightened.
--The rule was read and Miss Hercock acknowledged she understood it.
--The Committee firstly addressed information 6444. Mr Goodwin demonstrated head on and side on films of the alleged incident. Miss Hercock had no questions of Mr Goodwin nor did she wish to give her interpretation of the film.
--The films clearly showed Miss Hercock’s mount shift inwards when not clear of AIMEES IDOL causing the rider of that horse to check his mount.
--The Committee were then shown head on and side on films of the alleged incident as referred to on Information 6443. These films were again shown and demonstrated by Mr Goodwin. Miss Hercock had no questions of Mr Goodwin nor did she wish to give her interpretation of the films.
--These films clearly showed the breached as referred to in the information.
--Miss Hercock admitted both breaches and offered no excuses for her actions or lack of same.
--Mr Ray felt both breaches warranted a term of suspension and emphasised the second breach was worse than the first as it effected more than one horse and was at the top of careless.
--The Committee asked for, and was given Miss Hercock’s record, which was very good. She was last charged under this rule was November 2006.
--When arriving at penalties the Committee took into account the following. Miss Hercock’s admission of the breaches and her very good record, however, these factors were outweighed by the fact that the breaches were not of a minor nature and warranted a term of suspension.
--On the first breach, they felt a suspension of 3 days was warranted, on the second breach they felt a suspension of 4 days, together with a fine of $750 was appropriate.
--The suspensions are to be served concurrently and total 7 days plus a monetary penalty of $750.
--The suspension commences at the conclusion of racing on the 13th October 2007 until the conclusion of racing on the 24th October 2007.
