Egmont RC 10 October 2020 – R 3 – Chair, Mrs N Moffatt
ID: JCA13895
Code:
Thoroughbred
Meet Title:
Egmont RC - 10 October 2020
Meet Chair:
NMoffatt
Race Date:
2020/10/10
Race Number:
R 3
Decision:
As Ms Taiaroa admitted the breach the charge was deemed proved.
Penalty:
Accordingly, Ms Taiaroa is suspended from the close of racing today, October 10th, 2020 up to and including racing on Saturday October 24th, 2020.
Facts:
Following the running of Race 3 (All Things Automotive Mdn 1300m), an Information was lodged by Mr J Oatham alleging a breach of Rule 636(1)(d) in that Temyia Taiaroa failed to ride her mount INDY FOX out fully to the finish when there was a reasonable chance of finishing in a higher placing.
Mr Oatham used synchronised side and head-on videos to explain the incident. At the 100m mark Ms Taiaroa was racing immediately adjacent to the running rail, and clearly in 2nd place. At this stage of the race she was riding with vigour but 2 strides short of the finish post she relaxed her position, stopped riding, and a horse on the outside (AMATHUSIA) got up to beat her. Ms Taiaroa finished in 3rd place beaten by a nose margin.
Submissions for Penalty:
Mr Oatham said Ms Taiaroa has a clear riding record for the last 12 months. It appeared to be an error of judgement when she stopped riding a little too soon, and the angle of the finish post may have been confusing.
Mr Oatham quoted the Judicial Penalty Guide which has a starting point of 4 weeks suspension and submitted that there were some mitigating factors which might offer Ms Taiaroa a reduction in penalty.
In response to a question from the Chair Mr Oatham said the difference in prizemoney between 2nd and 3rd placing was $800.
Ms Taiaroa was invited to make submissions on penalty. She said the films clearly showed she had stopped riding but at the time she did not see the outside horse as it was so far out on the track. She believed she was safely holding second place.
Ms Clapperton said there was only a nose between the two horses at the finish, and it was difficult for inexperienced riders when making split second decisions to get it right all the time.
Reasons for Penalty:
The Judicial Committee carefully considered all submissions.
It is the responsibility of every rider to ensure they ride out fully to the finish, and unfortunately Ms Taiaroa neglected to do so on this occasion. The connections of INDY FOX lost out on $800 of prizemoney and for the betting public, quinellas, trifectas and first four dividends were all affected.
The Penalty Guide for Judicial Committees has a sliding scale of starting points relating to the potential placing deemed to have been lost.
The starting point for missing second placing is a 4-week suspension, and we adopted this today.
There are however mitigating factors. Ms Taiaroa’s inexperience led to an error of judgement. She is an apprentice rider still learning her trade, and it is inevitable that she will make mistakes. Her record is excellent. Ms Taiaroa has been riding for 2.5 years and has had approximately 180 race day rides without appearing before a Judicial Committee.
Taking into account all the submissions it was our opinion that Ms Taiaroa be given a discount of half that of the starting point, 2 weeks suspension.
Mr Taiaroa advised the Committee of no riding commitments within the next 7 days therefore any suspension could begin immediately.
