Decision:

Following the running of Race 2, the Amcor Kiwi Packaging Maiden over 1200 metres, Mr. R.Norvall was charged with careless riding under Rule 638 (1) (d).

Following the running of Race 2, the Amcor Kiwi Packaging Maiden over 1200 metres, Mr. R.Norvall was charged with careless riding under Rule 638 (1) (d).

--

The information alleged that R. Norvall allowed his mount to shift inward near the 1000m when not clear of KING VICTOR (R. Hannam) who was dictated inward onto BIG EARN (V. Johnston) who in turn was dictated inward onto JUSTA BUDDY (L. Allpress) who was checked.

Mr. Norvall admitted the breach.

Mr. Goodwin began by showing the head-on video of the start of the race where he identified all of the runners involved. The film was played in slow motion and Mr. Norvall could be seen to move inwards in an attempt to get closer to the running rail. As he came across he put pressure on Mr. Hannam which was transferred to Ms Johnston and then onto Ms Allpress who was squeezed up on the fence.

The side-on view of the incident clearly showed Ms Allpress well up on the inside of Ms Johnson prior to the interference and then showed her getting checked backwards as Mr. Norvall came across.

Mr. Norvall said that the films were self-explanatory but that as soon as he heard calling from other riders he relieved the pressure by straitening his mount. Unfortunately the tightening had already occurred.

Mr. Neal told the committee that Mr. Norvall had two previous suspensions for careless riding in the previous 12 months.  He considered this a good record for a relatively active rider and put the offence in the mid-range.

Mr. Norvall said that he had riding engagements for Wednesday at Counties and that a new riding agent was encouraging him to ride more often in the South Island. His intentions were to be riding, in particular, at the Ashburton meeting on Sunday October 18th.

Penalty

--

In coming to a decision on penalty the committee took into account all of the submissions put before us including Mr. Norvall’s admission of the breach and his good riding record.  This has to be balanced with the fact that three horses were affected in particular Ms Allpress’s mount. We also considered the fact that Mr. Norvall did take corrective action albeit a little too late. The Stewards’ have indicated the offence lies in the mid-range and we agree with that assessment.

Mr. Norvall is suspended from the conclusion of racing on Wednesday October 14th (to allow him to fulfill riding engagements at Counties) until the conclusion of racing on Wednesday October 21st 2009.

--

This is considered by the committee to be a four day suspension as Mr. Norvall indicated no intention to ride at the Otago meeting on Friday 16th October but Ashburton 18th October has been included.
