For the above reasons the evidence does not satisfy us to the standard required that the protest should be upheld. The protest is dismissed.
Facts:
RED DRAGON placed 3rd by the Judge interfered with the chances of LUCKY BREAK placed 4th by the Judge in the final straight.
Submissions for Decision:
Mr Coles showed the video film of the run down the home straight.
Mr Taylor pointed out that shortly after entering the straight LUCKY BREAK was three wide outside RED DRAGON which then moved outwards and bumped LUCKY BREAK causing it to lose about half a length and also momentum. He said if RED DRAGON had not moved out he would have held it in. He said but for the interference, LUCKY BREAK would have beaten RED DRAGON because the margin between them at the finish was a long head.
Ms Wenn said the outward movements of RED DRAGON were caused by the outward movements of ABEAUTY which took the running line of RED DRAGON. She said LUCKY BREAK was never on terms with RED DRAGON and so Mr Taylor would not have been able to hold RED DRAGON in.
Mr Rae agreed with the evidence of Mr Taylor.
Mr Coles said RED DRAGON did cause interference to LUCKY BREAK when it first moved outwards, but the next two “bumps” were caused by the outward movements of ABEAUTY. He said LUCKY BREAK did not make any ground on RED DRAGON in the last 150 metres of the race and he did not think the placings should be changed.
Reasons for Decision:
The committee is satisfied RED DRAGON caused interference to LUCKY BREAK when the horses first made contact but did not cause the other two incidents. We do not accept the interference was as severe as described by Mr Taylor. We are in a state of doubt as to whether, but for the interference, LUCKY BREAK would have beaten RED DRAGON. It is at best a 50/50 call.
