After taking all the above matters into consideration, and adopting the JCA guidelines of 5 days suspension being the starting point, we accept Mr McNab's admission, which is balanced by the fact that his record during the past 12 months is a matter for concern. Accordingly we impose a period of suspension of (5) days which is to begin after racing on 17 November and conclude after racing on 25 November 2012. This suspension is imposed under the provisions of Rule 1106(2).

Facts:
Following the running of Race 9 an information was lodged by Stipendiary Steward Mr A Coles against apprentice jockey Mr M McNab alleging a breach of Rule 638(1)(d) in that he allowed his mount 'HE SURE IS' to shift in when not clear of 'CHAUSETTE' ridden by Mr R Hutchings, causing that horse to be checked.
Mr McNab was present at the hearing and admitted the breach.
Submissions for Decision:
Mr Robinson demonstrated the video films which showed 'HE SURE IS', at aproximately the 1100m position, was two horses outside the horse 'CHAUSETTE' in or near the lead. 'CHAUSETTE' was over-racing and had its head up in the air. 'HE SURE IS' was barely a length clear of that horse when Mr McNab shifted across in front of 'CHAUSETTE' causing that horse to be checked by its rider. Mr Robinson submitted that because 'CHAUSETTE' was racing erratically, and that he was not the required distance in front of it, Mr McNab should have given it more room for safety's sake.
When questioned by the Committee, Mr Coles stated that it would be difficult to say how this had affected the chances of 'CHAUSETTE' due to the fact it had taken place with approximately 1100 metres to run.
Mr McNab had nothing to say when asked for any comment on the incident.

As the breach was admitted we find the charge proved.

Mr Coles told the Committee that Mr McNab's record during the preceding 12 months was not great, and that he had incurred 5 periods of suspension during that time. He said that it was to Mr McNab's credit that he had admitted the breach in the first instance, and that it was a mitigating factor that the horse 'CHAUSETTE' had been over-racing at the time. He felt that the incident was a suspendable matter and that it fell into the mid-range level of seriousness.
Mr McNab said that he had engagements the following day at Tauranga and would prefer any period of suspension to begin after that date. On being questioned by the Committee he acknowledged that he did have engagements after the Tauranga meeting but that he would definitely be able to dis-engage himself from them. He stated that he rode in the South Island occasionally, and had ridden at Canterbury on 6 October and 22 September.

We take into account that the incident took place in the back straight with approximately 1100 metres to run, and that the affected horse - CHAUSETTE - had been over-racing. However, balancing those matters there had been an inwards movement by HE SURE IS which was not the required distance clear which may have affected the chances of CHAUSETTE and could have been a safety issue for other runners in the race. We find this breach to be in the mid-range on the level of seriousness.
