After taking all of the above into consideration adopting a starting point of 5 days suspension for careless riding charges, with mitigating factors of an early admission and the inexperience of the horse concerned, and  under the provisions of Rule 1106(2) we impose a period of suspension on Mr Norvall from riding in races which is to commence after racing on 17 November 2012 and conclude after racing on 24 November 2012 (4 days).

Facts:

Following the running of Race 8 an Information was filed by Stipendiary Steward Mr A Coles against licensed jockey Mr R Norvall alleging a breach of Rule 638(1)(d)  in that he permitted his mount 'TRAVEL WISE' to shift inwards shortly after entering the final straight when not clear of 'JUSTTHEANSWER' (Ms D.JOHNSON) which in turn shifted in making contact with 'CORNELIUS' (D.NOLAN) with both runners subsequently being checked.

Mr Norvall was present at the hearing of the information and admitted the breach.

Submissions for Decision:

Mr Robinson demonstrated the video films which showed TRAVEL WISE ridden by Mr Norvall on the outside of the leaders as it turned into the home straight. Mr Norvall was riding the horse forward, and struck TRAVEL WISE  with his whip which caused the horse to move in towards the horses inside it. As a result, JUSTTHEANSWER, Ms D Johnson was checked and moved in onto CORNELIUS ridden by Mr D Nolan, which was also checked. 

Mr Robinson stated that it was not the worst case he had seen, and that the horse TRAVELWISE was racing 'greenly' and had possibly over-reacted when struck with the whip. However he also said that Mr Norvall had continued to ride the horse forward after that incident and would have liked to have seen some patience from Mr Norvall.

Mr Norvall had nothing to add. He said he felt the facts had been covered by Mr Robinson.

Reasons for Decision:

As the breach was admitted we find the charge to be proved.

Submissions for Penalty:

Mr Coles stated that the incident had caused a severe check to the two runners on the inside of Mr Norvall's mount. He accepted that the horse TRAVELWISE was racing greenly, however he felt that Mr Norvall was a 'bit slow' in attempting to straighten his mount.

Mr Coles stated that Mr Norvall had an excellent record, and that he had no breaches of the subject Rule in the past 12 months. He was of the opinion that the breach fell into the lower end of the scale of seriousness, however still felt that a period of suspension was called for.

Mr Norvall stated that he was a North Island rider, and that he would prefer any period of suspension to begin after racing at Tauranga the following day, 17 November 2012.

Reasons for Penalty:

The Committee has considered all the evidence and submissions. We take into account that the horse TRAVEL WISE was having its first race-day start, and was racing greenly. We accept that Mr Norvall has admitted the breach at the first opportunity. Balancing this is the fact that Mr Norvall caused interference to two horses inside him at what was a fairly crucial part of the race and may have impeded the chances of those horses from finishing in a better position.  Added to this is the fact that Mr Norvall continued to ride the horse forward after it had reacted to the whip and was racing erratically. We find the breach to be in the lower end level of seriousness.
