As Mr McKay admitted the breach the Committee found the charge proved.

Penalty:

Accordingly the Committee imposes a period of suspension on Mr McKay which will commence after racing on 21 November at New Plymouth and conclude after racing on 27 November 2014-4 North Island riding days.

Facts:

Following the running of Race 6, the CITY OF AUCKLAND SUPPORTERS GROUP MAIDEN 3YO MAIDEN, an Information was filed by Stipendiary Steward Mr A Coles alleging a breach of Rule 638(1)(d) by Apprentice Rider Mr S McKay in that he permitted his mount OFFSPRING to shift inwards near the 300 metres when not sufficiently clear forcing CANDID MAN (Mr B Hutton) inwards striking a heel of MAGIC MOMENT (Mr M Cameron) and blundering.

Mr McKay, assisted by Mr A Peard, was present at the hearing and confirmed that he admitted the breach. He also acknowledged that he understood the Rule and the nature of the charge.

Rule 638(1)(d) provides:  A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Oatham demonstrated the incident on the available video films. He identified OFFSPRING ridden by Mr McKay in a 'loose' 3 wide position near the 300 metres. Mr Oatham pointed out that OFFSPRING had been allowed to shift inwards by its rider when it was not the required distance clear of CANDID MAN ridden by Mr Hutton which was on its inside. As a result CANDID MAN shifted in, clipping a heel of MAGIC MOMENT and blundering. Mr Oatham advised the Committee that Mr McKay should have stopped riding his mount forward and made a greater attempt to straighten his mount.

Mr Peard agreed that Mr McKay should have taken corrective action earlier than he did, adding that he was inexperienced and did not 'read' what was taking place quickly enough.

Submissions for Penalty:

Mr Coles produced Mr McKay's riding record. He said that he was a young, inexperienced rider who in a limited career had received one period of suspension for a breach of this Rule. Considering he had had over 100 rides Mr Coles felt that his record to date could be considered good. Balancing that Mr Coles added that he should have straightened his mount earlier, and stated that the Stewards considered this breach to be low-mid range in seriousness. He added he felt the incident could have had a worse outcome but it was to Mr McKay's credit that he had made an early admission of the breach.

Mr McKay advised the Committee he was riding at New Plymouth on 21 November and his suspension could take effect after that.

Reasons for Penalty:

The Committee considered the submissions and evidence presented. We adopted a 5 day suspension as a starting point as per the JCA Penalty Guide. To Mr McKay's credit is that he admitted the breach, and that his record to date having ridden in over 100 races is good. Against that is that the incident could have had more serious consequences if Mr Hutton had not been so quick to take evasive action. The Committee agreed that the incident was relatively low range. Taking all of the above into consideration the Committee believe that a term of suspension of 4 riding days is appropriate.
