Accordingly the protest is upheld and the placings are now:

1st no.5 PURPOSE
2nd no.9 SIMPLY IRRESISTIBLE
3rd no. 1 APATCHEE TUTE
4th no.10 ADHIRA

In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 9 Mr M Cameron, Rider of the third placed horse SIMPLY IRRESISTIBLE, lodged a protest pursuant to Rule 642(1).  He alleged that APATCHEE TUTE, placed second by the judge, caused interference to SIMPLY IRRESISTIBLE in the final straight.
The judge’s placings were as follows:

1st no.5 PURPOSE
2nd no.1 APATCHEE TUTE
3rd no. 9 SIMPLY IRRESISTIBLE
4th no.10 ADHIRA

The official margin between 2nd and 3rd was half a head.

Submissions for Decision:

Mr Cameron demonstrated the alleged incident using all the available video films. He pointed out to the committee at the 300 where he is placed 3 back on the running rail with Ms Vance riding APACHEE TUTE racing directly in front of him. He said a clear run was presented for him to improve until Ms Vance shifted ground when only a bare length in front of him. This resulted in him being hampered and losing momentum. He said SIMPLY IRRESISTIBLE made up 1 ½ lengths on APACHEE TUTE over the final 200 metres.

Mrs Rae said APACHEE TUTE was travelling well in the trail and believed Mr Cameron overreacted when he received a check.

Ms Vance conceded APACHEE TUTE rolled into the fence more than she wanted to. She said Mr Cameron’s mount was inconvenienced for only 2 strides.

Mr Nash said there was a gap along the rails for APACHEE TUTE and believed he was entitled to the run. The committee explained to Mr Nash that when riders shift ground they must be at least 2 lengths clear.

Mr Williamson when asked for his assessment submitted that the head-on film showed SIMPLY IRRESISTIBLE was denied its rightful running line when Ms Vance shifts across. This resulted in Mr Cameron taking hold of his mount. He said SIMPLY IRRESISTIBLE would have beaten APACHEE TUTE if interference had not occurred. He noted SIMPLY IRRESISTIBLE made up 2 lengths in the final straight.

Mr Cameron when given the opportunity to sum up said the interference had cost his mount from winnning the race.

Reasons for Decision:

The committee carefully considered all evidence and submissions presented and reviewed the video films on several occasions.

The video films clearly showed that Ms Vance permitted her mount APACHEE TUTE to shift inwards near the 300 metres when not sufficiently clear of SIMPLY IRRESISTIBLE. This resulted in SIMPLY IRRESISTIBLE being checked and lose at least 2 lengths. It was significant that over the final 200 metres SIMPLY IRRESISTIBLE made up 1¾ lengths on APACHEE TUTE to be only ½ a head off that horse at the finish.

For these reasons we are satisfied that SIMPLY IRRESISTIBLE would have beaten APATCHEE TUTE had interference not occurred.
