Facts:
Following the running of Race 8 Mrs L Rae, Trainer of the 4th placed horse FLASH HAPI, lodged a protest pursuant to Rule 642(1). She alleged that DENVER, placed first by the judge, caused interference to FLASH HAPI in the final straight.
The judge’s placings were as follows:
1st DENVER no.8
2ND THE BEEKEEPER no.4
2ND NEARLY STOLEN no.9
4th FLASH HAPI no.1
The official margin between 1st and 2nd was a length and a half, with a dead heat for second and a further ½ head back to the fourth placed horse.
Submissions for Decision:
Mrs Rae demonstrated the alleged incident using all the available video films. She highlighted to the committee at the 300 metre when DENVER rolls in and hinders FLASH HAPI’s momentum.
Ms Vance said FLASH HAPI was inconvenienced when DENVER moved in at the 300 metres. She said her mount hit the running rail and lost momentum. She said FLASH HAPI required the whole length of the straight to wind up.
Mr Manning said DENVER rolled off a fraction at the 300 metre. He did not believe there was an opportunity for FLASH HAPI to improve on DENVER’s inside. He firmly believed DENVER won the race convincingly and noted FLASH HAPI was being ridden out over the last 200 metres and made no ground on DENVER.
Ms Johnson said her mount rolled off slightly on the turn, but she straightened it up. She said DENVER drew away from FLASH HAPI in the final straight and believed her mount won too well.
Mr Williamson, when asked for his assessment, said it was clear on the films that DENVER does roll in onto FLASH HAPI at the 300 metres, however, he submitted that FLASH HAPI was not making any significant ground on DENVER in the final straight. He said with the margin being 1 ½ lengths he did not support a change of placings.
Reasons for Decision:
The committee carefully considered all evidence and submissions and reviewed the video films. We established that FLASH HAPI had to be eased when disappointed for a run on the inside of DENVER who rolled in near the 300 metres. However the video films clearly showed that for the final 200 metres of the race FLASH HAPI when presented with clear racing room and ridden forward it does not take any ground of DENVER who won the race by 1 and a half lengths.
For these reasons we are not satisfied that FLASH HAPI would have beaten DENVER had interference not occurred.
