Decision:

Following Race 5 an information was filed pursuant to Rule 871 (1) (d). The informant Stipendiary Steward Mr A. Coles alleged that near the 450 metres J McDonald riding (NICOLE AMY) shifted out when not clear of TERABYTE (D. Johnson) causing that horse a sharp check.

Following Race 5 an information was filed pursuant to Rule 871 (1) (d). The informant Stipendiary Steward Mr A. Coles alleged that near the 450 metres J McDonald riding (NICOLE AMY) shifted out when not clear of TERABYTE (D. Johnson) causing that horse a sharp check.

Mr McDonald admitted the breach and informed the committee he did not require a representative.

Mr Williamson demonstrated the video films from the 450 metre mark which clearly showed Nicole Amy ridden by Mr Mc Donald shift out when not the required distance clear resulting in a sharp check to Terabyte.

Mr McDonald said it was obvious on the films, although he stated there was movement from his outer.

Penalty Submissions

--

Mr Coles said Mr McDonald had 3 previous charges in the last 10 months ranging from 4 to 6 days suspension. He submitted this offence was at the lower end of the scale and recommended a 4 day suspension would be appropriate.

Mr McDonald said he had firm commitments up to and including July 11th.

Penalty

--

The Committee carefully considered all submissions and before imposing an appropriate penalty took into account the following:

--

1: The guilty plea.
2: Mr McDonald’s record.
3: Level of carelessness lower range.
4: The interference suffered by Ms Johnson.

--

Accordingly we impose as suspension to start after racing on 11th July and to conclude after racing on the 17th July 2009 (4 days).
