CHARGES:
--Following race 2 an Information was filed pursuant to Rule 638(3)(b). The informant, Stipendiary Steward Mr J Oatham alleged, that Mr Lammas used his whip on SONNY LISTON in an excessive manner.

Mr Lammas admitted the breach.

FACTS:
--Mr Williamson, Stipendiary Steward, demonstrated the video films which clearly showed Mr Lammas striking his mount excessively prior to the 200 metres without giving any respite. He counted Mr Lammas had hit his mount 17 times which is well outside the guidelines.
----
SUBMISSIONS(s)
--Mr Lammas, when asked, admitted he used his whip excessively. He said he kept his mount going with the whip as he was in contact with the leaders, but conceded he had misjudged the quantity of times he used the whip.
----
SUBMISSIONS(s) ON PENALTY
--Mr Oatham informed the Committee this was Mr Lammas first whip charge, he had admitted the breach and was co-operative with the stewards. He said Mr Lammas had a very good record but stated he was well outside the guidelines. He submitted a fine at the lower end of $200 would be appropriate.

Mr Lammas when invited to make submissions on penalty had nothing to say.

REASON(s):
--The Committee carefully considered all evidence and submissions before imposing penalty. Because this was Mr Lammas first charge under this rule and he has admitted the breach we determine that the penalty be at the lower end.
----
PENALTY:
--Accordingly we impose a fine of $200.
