Penalty:
After balancing all the above factors and placing emphasis on Mr Taylor’s excellent record and the breach was at the low end of the scale we impose a fine of $150.00. The committee advised Mr Taylor that any further breaches of this rule would result in an increased fine.
Charge:
Following race 5 the informant Mr J Oatham lodged an information pursuant to rule 638(3)(b). He alleged that Mr Taylor used his whip on D’NOOD LADY in an excessive manner.
Facts:
Mr Williamson demonstrated the video films and pointed out to the committee Mr Taylor striking his mount 12 times from the 400 metres until the final 200 metres. He said Mr Taylor was hitting his mount every 2nd or 3rd stride, however he was well outside the guidelines.
Mr Taylor said his mount was an awkward ride and although conceding he was outside the guidelines he believed the long straight at Counties on a heavy track had a bearing on his performance. He said he was giving his mount back flicks with the whip but did not believe it was in an excessive manner.

Mr Oatham said Mr Taylor had never been charged before under this rule, he said Mr Taylor had not appeared before the stewards on a charge in the last year which is an excellent record. He submitted the breach was at the low end of the scale and a monetary penalty reflecting that would be appropriate.
Mr Taylor submitted that he had worked hard to have a clear record. He believed the contributing factors in the incident were riding an awkward horse on a long straight which resulted in him been caught out.

The committee carefully considered all evidence and submissions presented. Mitigating factors are Mr Taylor’s excellent record, his admission of the breach, we have assessed the breach to be at the lower end and noted his mount was an awkward ride. The aggravating factor however was that Mr Taylor failed to give his mount the required respite prior to the final 200 metres.
