Facts:
Following the running of race 4, Betavet 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Stipendiary Steward Mr Jones, alleged that Mr BR Jones permitted his mount BREAK THE RULES to shift in passing the 1200 metres when insufficiently clear of SHARWING which was crowded and checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones said he understood the Rule and confirmed that he admitted the breach.
Mr Williamson demonstrated the incident using the available video footage. He identified that Mr Jones allowed his mount to shift in when just 1 length clear SHARWING. As a result Ms Thornton had to take a hold of her mount when crowded for racing room.
Mr Jones said that his mount was a difficult ride and had a tendency to get on one rein.

Mr Jones said that Mr Jones had 2 previous breaches under this Rule in the last 12 months. The most recent being 1/6/2019 which resulted in a 5 day suspension. He said to Mr Jones’ credit he admitted the breach and he described the level of carelessness as low range.
Mr Jones said that he had an engagement at Tauranga on 11 September and therefore sought a 7 day deferment to his proposed suspension.

The Committee considered all the evidence and submissions presented.
It was clear on the video films that Mr Jones permitted his mount to shift in 1 horse width near the 1200 metres when only 1 length clear of SHARWING. As a result that runner lost its rightful running line when crowded and checked. The Committee deemed the level of carelessness displayed by Mr Jones was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national days which was adopted.
There were no aggravating factors that warranted an uplift in penalty.
Mr Jones’ record was considered to be a neutral factor.
The mitigating factor was Mr Jones’ admission of the breach. For this he was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
