The Committee having reviewed the films ruled that SHOWOROSES was denied a fair start and it was declared a non-runner.
The amended placings are: first (10) MELT
second (4) PRINCESS RIHANNA
third (2) SHEEZALLMINE

fifth (3) WEAPONRY
It was ordered that dividends and stakes be paid in accordance with the amended placings.
Facts:
Following the running of the ROGER GILL MITSUBISHI 1200 an Information Requesting a Ruling was lodged by Ms S Collett the rider of SHOWOROSES alleging that SHOWOROSES did not receive a fair start.
The Information was lodged pursuant to Rue 632(1) which provides: If, in the opinion of the Judicial Committee, a horse which does not finish in the first four placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.
Ms Collett was present at the Hearing in support of the Request for a Ruling.
Mr Williamson demonstrated the incident by use of the race films and showed where the gates had opened but the right hand gate had not remained open and had bounced back into the line of SHOWOROSES. Mr Williamson explained that there were suction cups on the gates and when they open they stick to each other and remain open. It did not happen in this case.

Ms Collett said her horse was normally a good beginner but because the gates did not open properly her horse did not jump out as it normally would.
Mr Williamson said that it was hard to disagree with SHOWOROSES being denied a fair start.

The race films showed that the right hand gate for SHOWOROSES had opened but had then sprung back into its line and it had to force the gate back open. In doing so the Committee ruled that it was denied a fair start.
