Penalty:
We impose a suspension of 4 riding days commencing after racing on 2 October 2011 until the conclusion of racing on 9 October 2011.
Charge:
The information alleged that Mr P Taylor permitted his mount MADISON AVE to shift inwards after the start when not sufficiently clear of GOODIWINDI which was dictated inwards causing crowding to TIME PAYS, TSARIO and DIRECT LINE.
Facts:
Stipendiary Steward Mr A Coles demonstrated the incident by way of front and head-on video footage. He said that shortly after the start of the race, Mr Taylor allowed his mount, MADISON AVE, to shift inwards when not sufficiently clear of GOODIWINDI (L Satherley). This caused crowding to TIME PAYS (C Lammas), TSARIO (D Nolen) and DIRECT LINE (S Collett). As a result TIME PAYS and DIRECT LINE were both checked and lost ground.
Mr Taylor told the Committee that "he was making a 'bee line' across and thought that he had cleared the horse on his inside". He said that he corrected his horse, but it was too late.
Submissions for Penalty:
Mr Oatham submitted that Mr Taylor has a good riding record with no breaches of this rule within the past 12 months. He said that Mr Taylor ought to be given credit for his early admission and that the breach was at the lower to mid-point in terms of seriousness. He also acknowledged that Mr Taylor had taken corrective action, albeit belatedly.
Mr Taylor submitted that he had an excellent riding record and that the breach was at the lower end of the scale. He said that if the Committee was to issue him with a suspension he has riding obligations confirmed for 2 October 2011.
Reasons for Penalty:
The Committee has noted that the inward movement which caused tightening to three horses was exacerbated by a chain reaction. The Committee acknowledges that Mr Taylor did take corrective action. We have also taken into account Mr Taylor's good riding record and his early admission of the breach. We have assessed the breach as being at the lower end of scale in terms of seriousness.
