As Mr Parish admitted the breach we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Parish which will commence after racing on 1st December 2011 and conclude after racing on 8th December 2011(4 days).
Charge:
Following race 9 an information was filed pursuant to Rule 638(1) (d). The informant Mr Williamson alleged that Mr Parish permitted his mount BIDDY THE BOOP to shift inwards shortly after the start when not sufficiently clear causing severe crowding to JUGGERNAUT ROCK (M Cameron), HIGH KIN (J McDonald) and EXORSISTER (A Taylor).
Facts:
Mr Coles demonstrated the video films which showed Mr Parish angle his mount in shortly after the start. This resulted in BIDDY THE BOOP ridden by Mr Parish moving into JUGGERNAUT ROCK when not clear, which in turn made heavy contact with HIGH KIN, which in turn made contact with EXORSISTER unbalancing that runner. He said that although there was crowding, none of the runners lost ground from the incident.
Mr Parish in admitting the breach said he believed the inside horse had come out a fraction which made the interference look worse on the films.
Mr Coles concurred there was slight movement from the inside.
Submissions for Penalty:
Mr Williamson produced Mr Parish’s record which showed no previous suspensions in the last 12 months. He submitted that the degree of interference was low range, however said that crowding cannot be condoned. He said with Mr Parish’s early admission and his excellent record a suspension at the low end would be appropriate.
Mr Parish informed the committee that he had commitments at Rotorua on the 1st December 2011. Mr Parish confirmed to the committee he only rides in the North Island.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. The mitigating factors are Mr Parish’s admission of the breach and his excellent riding record. The aggravating factors are his level of carelessness, which we assess as low end and the severe crowding to horses on his inside.
The Committee reminded Mr Parish that he needed to exercise more care when shifting ground.
