FACTS:

--

Following Race 4 an Information was filed pursuant to Rule 638 (3)(b).  The Informant, Mr Coles alleged that Mr M Walker used his whip in an excessive manner in Race 4.

Mr Walker admitted the breach.

--

Mr Williamson demonstrated the video films which clearly showed Mr Walker striking his mount 14 - 15 times prior to the 200 metres without giving his mount any respite.

Mr Walker in admitting the charge said that his only excuse was last time he had ridden the horse he got beaten by a nose and he did not want that to happen again.  On this occasion he won the race and his mount responded to the whip.

SUBMISSION(s) ON PENALTY:

--

Mr Coles told the Committee this was Mr Walker’s first whip charge, he had admitted the breach and was cooperative with the Stewards.  He submitted a fine of $200 - $250 would be appropriate.

Mr Walker had nothing to add regarding the penalty.

--

REASON(s):

The Committee considered all evidence before imposing an appropriate penalty.  Because this is Mr Walker’s first charge under this rule and he has admitted the breach we determine that the penalty be at the lower end.

Accordingly we impose a fine of $200
