 FACTS:         

--

Following Race 1 a protest was filed pursuant to Rule 642(1).  The Informant, Mr B Foote alleged that KEEPA CHEVAL, placed first by the Judge, caused interference to CISSY BOWEN, placed second by the Judge.  This interference was alleged to have occurred in the final straight.  The margin between first and second was a short neck.

The Informant, Mr B Foote, demonstrated the video films and sowed that at a point, soon after turning for home, there was a gap between ROCKADUBAI and KEEPA CHEVAL for his horse CISSY BOWEN to improve into.  He said that KEEPA CHEVAL lent on CISSY BOWEN for some strides preventing a free run. He believed this cost the filly a winning chance.

Miss Vance, rider of CISSY BOWEN, admitted that ROCKADUBAI did roll out slightly, but believed that KEEPA CHEVAL was the main contributor to her tightening.

Mr McKee, trainer of KEEPA CHEVAL, said his horse kept straight and Miss Vance did not have to stop riding.  He also said ROCKADUBAI did move out slightly as well and did not believe CISSY BOWEN was affected at all by KEEPA CHEVAL.

Miss Spratt, rider of KEEPA CHEVAL, said she could not have kept much straighter.

--

Mr Coles, when asked for his assessment, said that initially there wasn’t a gap for CISSY BOWEN to take.  He said that when there was KEEPA CHEVAL kept a straight line and Miss Vance, on CISSY BOWEN, did not have to stop riding.

DECISION:

--

The Committee carefully considered all evidence and reviewed the video films.  It is not satisfied that CISSY BOWEN would have beaten KEEPA CHEVAL if interference had not occurred. 

--

REASON(s):

--

1)      It is clear on the video films that KEEPA CHEVAL did keep a straight line in the run to the post.

--

2)      Miss Vance did not stop riding CISSY BOWEN at any stage and the Committee is of the opinion that Miss Vance’s mount moved out on its own accord.

--

3)      It is also evident that ROCKADUBAI moved out slightly adding to the incident.

--

Accordingly the Committee dismisses the protest and the Judge’s placings shall stand
