As the breach was admitted we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Razali which will commence after racing on 2March 2011 and conclude after racing on 12 March 2011 (5 riding days).
Charge:
Mr Coles alleged that passing the 200 metres Mr Z Razali (THE PENTAGON) allowed his mount to shift out into the line of PETERGABRIEL (J Morris) when not sufficiently clear causing PETERGABRIEL (J Morris) to be checked.
Facts:
Mr Williamson demonstrated the video films which showed Mr Razali mount shift out when being ridden forward with the whip. This resulted in PETERGABRIEL receiving a sharp check. Mr Williamson said Mr Razali mount was not sufficiently clear when shifting ground.
Mr Wiles conceded that Mr Razali mount did roll out when not the required distance clear. He said the horse had a reputation of being difficult to ride.
Submissions for Penalty:
Mr Coles said Mr Razali horse clearly came out badly crowding PETERGABRIEL. He produced Mr Razali’s record which showed one previous suspension on 12 February 2011. He submitted a suspension of 4-5 days taking into account his admission of the breach.
Mr Razali said he had commitments at Te Rapa on 2 March 2011. Mr Razali confirmed to the committee he rides only in the North Island.
Reasons for Penalty:
The committee carefully considered all evidence and submissions presented. Mitigating factors are Mr Razali's admission of the breach and his good record.The aggravating factor was he continued to ride forward with the whip when his mount was shifting out. He should have stopped riding and straightened up his mount to avoid interference to runners on his outside. The committee reminded Mr Razali this is his 2nd charge for careless riding this month and he needed to be mindful of the consequences of his actions when shifting ground when not clear.
