As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Arumugan which will commence after racing on 27th February 2011 and conclude after racing on 9th March 2011 (4 riding days).

Charge:

Mr Coles alleged that Mr T Arumugan (SCARED STIFF) shifted out when not clear and checked (CHAPARRONE) D Johnson and (ARTIC HEIGHTS) A Ng.

Facts:

Mr Williamson demonstrated the video films which showed Mr Arumugan allowed his mount to shift out when riding forward with the whip. This resulted in both CHAPARRONE and ARTIC HEIGHTS being checked. Mr Williamson said he conceded that the 2 horses receiving checks were attempting to take the same gap.
Mr Forbes conceded that Mr Arumugan was 2 strides too late in straightening his mount.

Submissions for Penalty:

Mr Coles said the video films clearly showed Mr Arumugan should have stopped riding forward when his mount was shifting out. Mr Coles produced Mr Arumugan’s record which showed one previous charge for careless riding in the last 8 months. He submitted a suspension at the lower end would be appropriate.
Mr Arumugan said he had no commitments in the next 7 days. He confirmed to the committee he only rides in the North Island.

Reasons for Penalty:

The committee carefully considered all evidence and submissions presented. Mitigating factors are his admission of the breach and his good record. The aggravating factor was that Mr Arumugan continued to ride forward with the whip. He should have stopped riding and straightened up his mount to avoid interference to 2 runners.
