As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Ms Johnson which will commence after racing on 27 February 2011 and conclude after racing on 6 March 2011 (5 riding days).

Charge:

Mr Coles alleged that approaching the 150 metres D Johnson (KNIGHTS HORIZON) allowed her mount to shift in under pressure into the line of AL FADEE ( J Whiteside) which clipped a heel and blundered.

Ms Johnson told the committee she did not need a trainer to represent her during the hearing.

Facts:

Mr Williamson demonstrated the incident on the video films. KNIGHTS HORIZON ridden by Ms Johnson lay in at the 200 metres and take the rightful running line of AL FADEE who received a significant check when clipping a heel. The side on film showed that Ms Johnson was never clear of the horse to her inside when she shifted in.
Ms Johnson said she was trying to pull her mount out but conceded it was too late.

Mr Coles said Ms Johnson had an excellent record with no careless riding charge in the last 12 months. He believed it was an error of judgment with Ms Johnson taking corrective action 2 strides too late. He confirmed Ms Johnson is a national rider and submitted a suspension at the lower end.
Ms Johnson said he had no commitments and would like the suspension to start immediately.

Reasons for Penalty:

The committee carefully considered all evidence and submissions presented. Mitigating factors are her admission of the breach and her excellent record.  However the aggravating factor was Ms Johnson continued to allow her mount to shift in for over 100 metres when not sufficiently clear. The interference nearly resulted in Ms Whiteside being dislodged from her mount. We believe the interference was in the mid range. The committee accepts that Ms Johnson is a national rider.
