Mr Jones has admitted the breach, which we thus find proved.

Penalty:

Mr Jones is fined the sum of $150 and reminded of his obligations under the Rules of Racing.

Charge:

Mr Coles alleged that Mr Jones used the whip excessively on his mount MYTHICAL in race 7.

Facts:

Mr Coles demonstrated on the video that the defendant used his whip some 14 times before the 200 metres without pausing for 6 strides as required by the guidelines.

Mr Jones accepted this but asked us to consider that weather conditions were so bad that he was forced to use two sets of goggles and as he was some distance away from the rail, with poor visibility, he was unable to see where the 200 metre marker was. He explained that a steeplechase fence that was usually sitting on the outside of the track and which he used as a marker had been removed. He accepted he had made a miscalculation as he was intending to give MYTHICAL the allowable 6 strikes immediately prior to the 200 metres.

Submissions for Penalty:

Mr Coles placed the defendant’s record before us. This showed that Mr Jones had no breach of this rule in the last 12 months and Mr Coles indicated he could not remember when he last spoke to Mr Jones about a whip issue. He submitted that a fine in the range of $150 to $200 was appropriate.

Mr Jones said he had ridden 500 odd winners and had never been charged under this rule. He re-emphasised the terrible weather conditions in which the jockeys were riding.

Reasons for Penalty:

We accept Mr Jones submission that the weather played a part in his poor decision making today. However, he is an experienced jockey and should have been aware where the 200 marker was and, if unsure, he should not have elected to try and give 6 strikes immediately before that mark.

We have regard to the defendant’s excellent record with respect to this rule and his admission of the breach. We have previously imposed a fine of $150 for a breach of this rule in similar circumstances earlier today. We see no need to differentiate penalty on this occasion.
