Facts:
Following the running of the MOUNT SHOP an Information was lodged by Stipendiary Steward Mr A Coles against Class A Rider Mr M Cameron alleging that Mr Cameron used his whip excessively when riding EXCALIBUR prior to the 100 metres mark.
Rule 638(3)(b)(ii) provides : a Rider shall not strike a horse in a manner or to an extent which is excessive.
The new Whip Use Guidelines essentially provide that inside the last 600 metres of a race and prior to the 100 metres mark a rider may use his/her whip 5 times and must then stop for 5 strides before using the whip again. The 5 on 5 off policy applies up to the 100 metres mark.
Mr Cameron was present at the Hearing and he advised the Committee that he understood the Rule and the Guidelines and that he admitted the breach.
Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films and showed where Mr Cameron had struck his horse 9 times without the required respite.
Mr Cameron said that he accepted the number of strikes and said that he had got carried away. He said he hit his horse every second or third stride but acknowledged that he did not stop for the required 5 strides.
Submissions for Penalty:
Stipendiary Steward Mr A Coles advised the Committee that this was Mr Cameron's second breach of this Rule and that the appropriate fine for a second breach should be imposed.
Mr Cameron accepted that submission.
Reasons for Penalty:
The breach is admitted, the incident is clearly shown on the race films and this is Mr Cameron's second breach. The appropriate penalty is a $500.00 fine.
The policy provides that only exceptional circumstances are to be taken into account by way of mitigation. The policy further provides that an admission of the breach and a good record are not mitigating factors and therefore we have not taken these into account.
