The information charged the Defendant, apprentice jockey C Parish, with a breach of Rule 856 (1) in that he failed to weigh in for 6th placing on Rover's Return,

Decision:
--The information charged the Defendant, apprentice jockey C Parish, with a breach of Rule 856 (1) in that he failed to weigh in for 6th placing on Rover's Return, at the conclusion of race 7 at the meeting.
--The Defendant, represented by Mrs T Thornton, confirmed both his understanding of the breach and that he admitted to the breach.
--The Informant advised the Committee that at the conclusion of race 7, he noticed that only five riders had weighed in, and that when he went to the jockeys room, he found the Defendant there, preparing to weigh out for the next race. He sought an explanation from the Defendant, who explained that when he came into the birdcage area he saw that all the stalls for placed horses seemed to be occupied, and that as he had not heard the call, he assumed that he was not required to weigh in.
--Whilst accepting the Defendants explanation, that it was an error of judgment, the Informant stressed to the Committee that it was the rider's responsibility to check if he was required to weigh in.
--For the Defendant, Mrs Thornton submitted that the Defendant believed, on his return to the birdcage, that he had placed in eight place and was not required to weigh in. The Defendant confirmed the Informant's account of his explanation.
--Addressing penalty, the Informant submitted that the penalty should be monetary, and that the sum of $150.00 was an appropriate amount ? consistent with recent like offending. He requested that the Committee also rule in terms of the rules relative to the disqualification of Rover's Return from sixth placing and the issue of the Defendant's riding fee.
--Penalty:
--The Committee accepted that the Defendant had made an error of judgment, and that the penalty should be of a monetary nature.
--A fine of $150.00 was imposed.
--In terms of Rule 856 (1), Rover's Return was disqualified from the race, and under Rule 523 (3), the Committee determined that the disqualification circumstances did not warrant a direction that the Defendant retain his riding fee, which was duly forfeited.
