--The Committee convened to hear a protest lodged by Mr AR Coles, Stipendiary Steward, alleging that interference by GENUINE OFFER (jockey L Cropp) ? placed first by the Judge, affected the chances of AUTHENTIC CROSS, (jockey G Cooksley) placed second, in race 5, the Joan Keven ? Honorary Member 1670.
--Mr Coles confirmed to the Committee that all parties had been advised of the protest hearing.
----The Judge's placings were:
--GENUINE OFFER (8) first
--AUTHENTIC CROSS (3) second
--PURINSESU (10) third.
--The margin between first and second was ? of a length.
--The protest was lodged pursuant to Rule 876 (1) and sought the relegation of GENUINE OFFER. It was lodged in accordance with Rule 1107 (2) within two minutes of the last to be weighed in of the riders of the horses placed by the Judge, being weighed in.
--The first question the Committee was required to consider was whether AUTHENTIC CROSS was interfered with and whether GENUINE OFFER caused that interference as alleged.
--The Committee heard evidence from G Cooksley, rider of AUTHENTIC CROSS, who described how, when just before the turn into the straight, he moved up outside the leading horse GENUINE OFFER, ridden by L Cropp. As he moved into and down the straight he was forced out 6 horse widths by GENUINE OFFER. He had to take hold of his mount and such action cost him two lengths. Mr Cooksley stated that he had to balance his mount up and change ground to the inside. Mr Cooksley maintained that the interference "cost him the race", emphasizing that the margin at the finish, between first and second, was only ? length.
--Mr J Oatham, Stipendiary Steward, utilizing the video, demonstrated Miss Cropps mount, GENUINE OFFER, moving out when not sufficiently clear of AUTHENTIC CROSS ? dictating that horse's line and causing interference.
--Mr Oatham corroborated the account detailed by Mr Cooksley.
--Miss Cropp in her evidence contended that she was always 2 lengths clear of AUTHENTIC CROSS and that her mount won easily, easing up at the finish.
--Mr Baker, trainer of GENUINE OFFER, reiterated Miss Cropp's evidence.
--Decision
--The Committee found that GENJUINE OFFER had interfered with AUTHENTIC CROSS, preferring the evidence from Mr Cooksley, and Mr Oatham's reading of the video.
--Having been satisfied that interference had occurred, it was necessary for the Committee to then consider whether that interference interfered with the chances of AUTHENTIC CROSS.
--The Committee found that:
--GENUINE OFFER had
--i. moved out when not sufficiently clear of AUTHENTIC CROSS
--ii. caused that horse to cover extra ground by dictating her line;
--and that Mr Cooksley
--i. had to stop riding his mount at a critical stage of the race
--ii was forced to move off his rightful line of running and
--iii. lost momentum.
--The Committee took into account the margin between the two horses at the time of the interference and then at the finish line, where the official margin was ? of a length.
--In accord with such findings, the Committee determined that the chances of AUTHENTIC CROSS were interfered with by the interference of GENUINE OFFER.
--Exercising their discretion, the Committee concluded that the protest should be upheld and ruled accordingly.
--The amended placings were:
--First 3 AUTHENTIC CROSS
--Second 8 GENUINE OFFER
--Third 10 PURINSESU
--Fourth 7 DIVISION
--Fifth 1 SHORT AND CURLY.
