Penalty:
Mr Kamaruddin’s licence to ride in races is suspended for a period of 3 (national) days commencing after racing on 25 July 2020 and concluding after racing on 1 August 2020.
Facts:
This charge arises from the running of Race 3, the Mount Shop 2100. Senior Stipendiary Steward Mr Williamson filed an Information pursuant to Rule 638 (1)(d) alleging that J Kamaruddin allowed (AL HARAM) to shift in over the final 100 metres when not clear of (WINDY HEIGHTS) which was contacted and impeded.
Apprentice rider Mr Kamaruddin acknowledged that he understood the Rule and confirmed his admission of the breach. He was assisted at the hearing by Mr N Harris (Northern Riding Mentor).
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Stipendiary Steward Mr Coles advised the Committee that Mr Kamaruddin’s mount (AL HARAM) won the race by a ½ length margin, but as a consequence of his actions there was an unsuccessful protest instigated by the connections of the second placed horse (WINDY HEIGHTS).
Using all available video footage Mr Coles demonstrated the incident that gave rise to this charge. He firstly pointed out an earlier incident in the run up the home straight when Mr Kamaruddin commenced to allow his mount to shift inwards. He stressed that this incident was not part of the charge but was indicative of the fact that AL HARAM drifted in for some distance. He said that as a result of the inward shift AL HARAM made contact with WINDY HEIGHTS at the 100-metre mark causing that horse to become momentarily unbalanced. From that point up the straight, he said that AL HARAM dictated WINDY HEIGHTS inward and again made contact a few strides before the finish line. He added that the inward movement was about 5 horse widths and Mr Kamaruddin should have stopped and straightened up his mount.
Mr Harris said that this was Mr Kamaruddin’s first race winner after having ridden several placings. He said that to his credit when it got tight Mr Kamaruddin did not use his whip.
Submissions for Penalty:
Mr Williamson produced Mr Kamaruddin’s riding record which indicated 1 previous breach of the careless riding rule during the past 12 months. This occurred on 4 October 2019 at Waikato resulting in a 5-day suspension for a low-end breach. He said he has had a total of 42 race day rides and is an inexperienced rider. Mr Williamson said that although it was low end carelessness, it did result in a protest by the connections of the second horse and it did deny WINDY HEIGHTS every opportunity to win the race. He added that Mr Kamaruddin was too slow to react when his mount commenced to drift inwards.
In response Mr Harris said that he agreed with the Stewards' assessment and penalty submission.
No deferment to any proposed suspension was sought.
Reasons for Penalty:
After considering the submissions the Committee determined Mr Kamaruddin’s carelessness to be low to mid-range and adopted a 4-day starting point. Although the Penalty Guide for Judicial Committees recommends starting points for low (6) and mid-range (8) carelessness; due to the COVID-19 impacts on racing, the agreed approach, until the end of the current season, for careless riding and like offending is for some leniency to be applied when setting penalties. This does not apply in cases involving more serious offences including whip breaches.
After reviewing the video footage, it was established that nearing the 100-metre mark WINDY HEIGHTS was in front of AL HARAM who was mounting a run wider on the track. AL HARAM commenced to shift inwards; it bumped into WINDY HEIGHTS and continued to dictate that runner inwards. Both horses brushed and raced in tight quarters with AL HARAM making reasonably solid contact with WINDY HEIGHTS approximately 2 strides prior to the winning post. Because Mr Kamaruddin did not take corrective action when it was prudent to do so, his level of carelessness is assessed as being slightly above the low range. The resultant protest was not upheld albeit interference was established.
The mitigating factors considered included Mr Kamaruddin’s admission of the breach and his good record, notwithstanding he has had limited race day riding opportunities. For those combined factors the Committee afforded him a 1-day reduction from the 4-day starting point.
After taking into account all the above factors the Committee considered that an appropriate suspension was 3 days.
