Following Race 5 an Information was filed pursuant to Rule 871(1)(d), when it was alleged by the informant, Mr. A. Coles, that Mr B Yuill, the rider of ALSZAAT, allowed his mount to shift inwards near the 300 metres when not sufficiently clear,
DECISION AND REASON:
--Following Race 5 an Information was filed pursuant to Rule 871(1)(d), when it was alleged by the informant, Mr A Coles, that Mr B Yuill, the rider of ALSZAAT, allowed his mount to shift inwards near the 300 metres when not sufficiently clear, causing a check to BREEZED, ridden by Ms S Spratt.
--Mr Yuill pleaded guilty, and was represented by his employer, Trainer Mr R Yuill.
--Mr J Oatham demonstrated the video films and showed where soon after turning for home Mr B Yuill allowed his mount to move in several horse widths and in doing so take the line of BREEZED, ridden by Ms S Spratt. He was not the required distance clear of Ms Spratt, and although he did straighten his mount, the correction was too late.
--Mr R Yuill, on behalf of his son, said this incident was really due to a lack of experience on his son’s part and that he would learn from the experience.
--Mr Coles said in his submissions on penalty, that it was Mr Yuill’s first charge and that he had not even incurred a warning beforehand. He believed a suspension was the appropriate penalty and suggested a minimum of 3 days.
--Mr R Yuill said he had nothing further to say, only to ask the Committee to consider his son’s inexperience.

--The Committee considered all submissions and in fixing penalty took into account the following:

- His guilty plea --
- The degree of carelessness and the resulting check to Ms Spratt.
Accordingly, we impose a suspension to start after racing on the 27th October 2007 and to conclude after racing on the 2nd November 2007 (3 days).
