As Ms Collett admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Ms Collett’s suspension pursuant to Rule 1106(2).

Accordingly, Ms Collett had her license to ride in races suspended for a period to commence after racing on 1 December and conclude after racing on 8 December 2018.

Facts:

Following the running of race 6, Lone Star Pukekohe 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Collett permitted her mount ZAPPEUR to shift inwards passing the 1100 metres causing ADIS (C Lammas) to be checked.

Ms Collett said that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr McLaughlin demonstrated the incident using the available video footage. He said that Ms Collett looked to her inside and she allowed her mount to shift in when only a bare length clear of ADIS. He said as a result that runner was checked passing the 1100 metres.

Ms Collett said that she misjudged her inward manoeuvre. In mitigation she said the pace of the race eased when she shifted in and ADIS improved quickly to her inside.

Submissions for Penalty:

Mr Williamson produced Ms Collett’s record which showed 2 previous breaches under this Rule in the last 12 months. He said this was a good record for such a busy rider and he accepted the pace eased when Ms Collett shifted in. He described the level of carelessness as low range and a suspension in line with that would be appropriate.

Ms Collett advised that she had upcoming engagements at Auckland RC on 1 December and sought a deferment to fulfil those commitments. Ms Collett added that her proposed suspension would mean she would likely miss the Premier race meeting on 8 December.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the video footage the Committee observed that Ms Collett permitted her mount to shift in 2 horse widths passing the 1100 metre when only 1 length clear of ADIS. As a result that runner was crowded and checked. The Committee deemed the level of carelessness displayed by Ms Collett was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which was adopted.

There were no aggravating factors.

The mitigating factors were Ms Collett’s admission of the breach and her good record for one of the busiest riders in the country. For these collective factors Ms Collett was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 days.
