As Mr Cameron admitted the breach we find the charge proved.

Penalty:

Accordingly, we impose a $300 fine on Mr Cameron.

Charge:

Following race 8, an information was filed pursuant to Rule 330(3)(c). The informant, Mr Oatham alleged that Mr Cameron failed to make the contracted weight for BONINSKY.

Facts:

Mr Oatham advised the committee that under normal circumstances this breach would have been treated as a minor infringement. However, he explained to us that because Mr Cameron was unable to make the weight on BONINSKY in the Group 2 Counties Cup at short notice he opted to lay an information. He said Mr Cameron was a good ¾ kilo over the carded weight and was replaced by Mr Sweeney.

Mr Cameron informed the committee that he thought he would be able to sweat and lose the weight difference. However, he conceded that he was unable to achieve his goal even allowing for the fact the connections had permitted him to be half a kilo over the carded weight.

Submissions for Penalty:

Mr Oatham produced Mr Cameron's record which showed his last breach under this rule was in February 2012. He submitted that it was not ideal for a leading rider to inform connections at short notice that he was unable to make the contracted weight. He said that the betting public were disadvantaged and were unable to change their bets. He submitted the status of the race was a significant aggravating fact and believed an appropriate penalty was a fine of not less than $300.

Mr Cameron when asked for his submissions on penalty conceded that Mr Oatham's submissions were appropriate. He accepted the short notice given to connections of being unable to make the weight and status of the race were aggravating factors.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Cameron's admission of the breach and his very good record. However, this has to be balanced against the aggravating factors which were the connections and betting public being informed only 1 hour prior to the race. The status of the race being a Group 2 worth $100,000 was a further aggravating fact. We concur with the breach being filed as an information and not a minor infringement and assess an appropriate penalty under these circumstances is a fine of $300.
