Following Race 7 an information was filed pursuant to Rule 876 (1) when it was alleged by Mr W Pike, owner of GRACE, that GENUINE OFFER and MELANION placed 1st and 3rd by the Judge, interfered with the chance of GRACE, placed 4th by the Judge

DECISION AND REASON:
--Following Race 7 an information was filed pursuant to Rule 876 (1) when it was alleged by Mr W Pike, owner of GRACE, that GENUINE OFFER and MELANION placed 1st and 3rd by the Judge, interfered with the chance of GRACE, placed 4th by the Judge. This was alleged to have occurred in the final straight.
--The margins at the post were 1 1/2 lengths, 1 1/4, 1/2, 3 lengths.
--All connections were informed of the protest. Present at the protest were :
--GRACE : Mr W Pike - owner; Ms D Johnson - rider
--GENUINE OFFER : Mr G Simon - representing owner; Mr R Norvall - jockey; Mr C Gibbs - trainer
--MELANION : Mr D Murray - trainer/owner; Ms S Spratt - rider.
--Mr W Pike demonstrated the video films and said GRACE was a long striding mare who took time to wind up again as a result of Mr Novall moving in and taking GRACE's line.
--Ms Johnson, rider of GRACE, said she was checked out by GENUINE OFFER which cost her approximately 5 strides.
--Mr Gibbs, trainer of GENUINE OFFER admitted his horse moved in but MELANION moved out as well contributing to the interference.
--Mr R Norvall, rider of GENUINE OFFER, said he had come in but said he put the stick away immediately.
--Mr G Simon, representing the owners of GENUINE OFFER, said the best horse clearly won the race, the interference was 200 metres from the post and MELANION contributed to the interference. He added that the 2nd horse also moved out causing MELANION to move out as well.
--Mr D Murray, owner/trainer of MELANION, said his horse has moved out very slightly but in his opinion played no part in the protest. Ms Spratt confirmed what Mr Murray stated.
--DECISION
--Stipendiary Steward Mr J Oatham, when asked for his assessment, said that as well as the inward movement from GENUINE OFFER there was also a contribution from MELANION moving out slightly. He said Ms Johnson did have to stop riding but asked the Committee to consider the 1/2 length margin and that the incident was 200 metres from the line.
--The Committee carefully considered all the evidence and reviewed the video films.
--There is no doubt that GRACE did receive interference approximately 200 metres from the post when GENUINE OFFER moved into its line, causing Ms D Johnson to check.
--
We now address the question of the chances of GRACE finishing in a better place being affected.
We have determined her chances were not affected for the following reasons :

- The interference was 200 metres from the finish, clearly giving GRACE time to recover. --
- The 1/2 length margin between 3rd and 4th. --
- The 3rd horse MELANION was finishing strongly with Ms Spratt relaxing somewhat prior to the line when realising she was clearly 3rd.
This leaves us with considerable doubt as to whether GRACE could have finished 3rd.
--Accordingly we believe GENUINE OFFER should not be relegated and the Judge's placings shall stand.
--We order the protest fee be refunded.
